The Montenegrin national competition authority (NCA) has performed an unannounced inspection (dawn raid) in the market for the sale of motor vehicles. It is investigating two local companies allegedly involved in RPM concerning the sale of motorcycles produced by Peugeot Motorcycles.

The investigation resulted from a sector inquiry. Specifically, the NCA was performing a sector inquiry into the market for post-sale services for motor vehicles (including motor cycles) and came across an agreement for the sale of motor vehicles produced by Peugeot Motorcycles. The agreement was between an importer and a reseller of Peugeot Motorcycles motor vehicles in Montenegro and allegedly contained an RPM clause.

Key takeaway

This is already a second dawn raid in Montenegro this year, following a raid in the market for the retail of electronic devices, performed in the spring. This indicates an increased level of antitrust activity of the Montenegrin NCA, in particular in the area of vertical agreements.
